ROLE PURPOSE

The Plaintiff Representative is responsible for initiating and managing legal actions against defaulting borrowers to recover outstanding dues on behalf of the bank. The role involves filing lawsuits, attending court proceedings, coordinating with legal teams, and ensuring compliance with banking and financial laws.

KEY ACCOUNTABILITIES:

• Initiate legal proceedings against defaulters under applicable laws.
• Draft and file petitions, complaints, and recovery suits in court
• Ensure timely legal action against borrowers with overdue loans, or non-performing Loan.
• Work with collection teams to strategize recovery approaches before legal action.
• Prepare and submit necessary documents, loan agreements, transaction records, and notices as evidence.
• Represent the bank in court as the plaintiff or work with external lawyer.
• Attend hearings, mediations, and arbitration proceedings.
• Maintain legal case files and records of all recovery actions.
• Engage in settlement discussions with borrowers to reach out-of-court resolutions when feasible.
• Work closely with internal and external legal teams, including lawyers and court officers, to ensure timely and effective handling of cases.
• Assist in preparing and reviewing documents for court hearings, including legal notices, affidavits, petitions, and settlement agreements.
• Communicate with clients and debtors regarding the status of their cases, repayment options, and upcoming court dates. Work to negotiate settlements where possible.
• Maintain accurate records of all case activities, deadlines, and court rulings. Prepare and present detailed progress reports on the status of cases to litigation team lead.
• Ensure that all relevant documents are filed with the courts and follow up on hearings, judgments, and enforcement actions in a timely manner.
• Participate in negotiations with debtors or their representatives to reach settlement agreements, reducing the need for prolonged legal proceedings.
• Ensure all court cases are conducted in compliance with relevant laws and banking regulations. Monitor the adherence to timelines and legal protocols in recovery cases.

QUALIFICATIONS REQUIRED

• Ability to work under pressure and meet deadlines.
• Proactive attitude in handling cases and resolving issues efficiently.
• Familiarity with banking regulations and compliance standards related to recovery and litigation.
• Knowledge of credit management systems and recovery procedures.
• Prior experience in dealing with court proceedings related to financial disputes or loan recovery.
• Exposure to settlement negotiation strategies.

Education & Special Training

• Bachelor’s degree in Law (LLB) or Finance or any graduate.

Experience

• Over 5 years of experience in court case management, legal recovery, or debt collections within a bank or financial institution.
• Experience in litigation, recovery processes.

Languages

• Fluent in English and Myanmar (written and verbal)
